This Product is operated by Coral Dreams. Coral Dreams is also referred to in these Terms as “we”, “our”, and “us”. By using our website to access our products, you agree to be bound by Section I of these Terms (“General Terms”), which contains provisions applicable to all purchasers and/or account holders and/or users of our website, including visitors to the Coral Dreams website (the “Site”). If you choose to register as a member of our website the Coral Dreams shop and/or website (www.coraldreamsart.com), you will be asked to check a box indicating that you have read, and agree to be bound by, the additional terms set forth in Section II of these Terms (“Additional Terms”). All brand, product and service names used in this Service which identify Coral Dreams or third parties and their products and services are proprietary marks of Coral Dreams and/or the relevant third parties. Nothing in this Service shall be deemed to confer on any person any license or right on the part of Coral Dreams or any third party with respect to any such image, logo or name.

Coral Dreams is, unless otherwise stated, the owner of all copyright and data rights in the Service and its contents and its products. You may not reproduce, distribute, publicly display or perform, or prepare derivative works based on any of the content including any such works without the express, written consent of Coral Dreams.

Coral Dreams demands users and/or account holders of the website to respect its copyrights. At Coral Dreams’ discretion and in appropriate circumstances, Coral Dreams may terminate the accounts of users or prevent access to the site by users who infringe its intellectual property rights. To file a copyright infringement notification (also commonly known as a “DMCA takedown notice”), the Coral Dreams (copyright owner) and/or its authorized agents and/or its authorized representatives acting on Coral Dreams’ behalf will need to collect the following information:

CORAL DREAMS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED AS TO THE OPERATION OF THE SERVICE, OR THE CONTENT OR PRODUCTS, PROVIDED THROUGH THE WEBSITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE AND/OR WEBSITE IS AT YOUR SOLE RISK. CORAL DREAMS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. Amendment of the Terms

We reserve the right to amend these terms from time to time in our sole discretion. If you have registered as a member, we shall notify you of any material changes to these terms (and the effective date of such changes) by sending an email to the address you have provided to Coral Dreams for your account. For all other users and/or account holders, we will post the revised terms on the site. If you continue to use the Service and/or website and purchase our products after the effective date of the revised terms, you will be deemed to have accepted those changes. If you do not agree to the revised terms, your sole remedy shall be to discontinue using the Service and/or purchasing products.

General

These terms constitute the entire agreement between Coral Dreams and you with respect to your use of the Service and/or purchasing of products. Coral Dreams’ failure to enforce any right or provision in these terms shall not constitute a waiver of such right or provision. If a court should find that one or more provisions contained in these terms is invalid, you agree that the most closely related term and/or relevant term will instantly apply and the remainder of the terms shall be enforceable. Coral Dreams shall have the right to assign its rights and/or delegate its obligations under these terms, in whole or in part, to any person and/or individual and/or business entity. You may not assign your rights or delegate your obligations under these terms without the prior written consent of Coral Dreams. These terms shall be governed by and construed in accordance with the laws of Cyprus. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the Cypriot courts and the Cyprus Judiciary.

Registration

To register as a member to the website in order to purchase our products, you must be 18 years or lawfully permitted to enter into and form contracts, unless it is a married individual and/or person who is under 18 years old and is capable of contracting, according to the applicable law(CAP 149 s.11(2)). In no event, may minors excluded under the applicable law submit content to the Service. You agree that the information that you provide to us upon registration, at the time of purchase, and at all other times will be true, accurate, current and complete. You also agree that you will ensure that this information is kept accurate and up to date at all times. This is especially important with respect to your email address, since that is the primary way in which we will communicate with you about your account and your orders.

Password

When you register as a member, you will be asked to provide a password. You are responsible for safeguarding the password and you agree not to disclose your password to any third party. You agree that you shall be solely responsible for any activities or actions under your password, whether or not you have authorized such activities or actions. You shall immediately notify Coral Dreams of any unauthorized use of your password.

to upload, post, or otherwise transmit any material that infringes any copyright, trade mark, patent, or other intellectual property right or any moral right of Coral Dreams but not limited to, or to facilitate the unlawful distribution of copyrighted content or illegal content;
to forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Service;
to upload, post, or otherwise transmit any material which is likely to cause harm to Coral Dreams or anyone else’s computer systems, including but not limited to that which contains any virus, code, worm, data or other files or programs designed to damage or allow unauthorized access to the Service which may cause any defect, error, malfunction or corruption to the Service;
for any commercial purpose, except as expressly permitted under these terms;
to sell access to the Service on any other website or to use Coral Dreams’ service and/or products on another website for the primary purpose of gaining advertising and/or subscription revenue and/or selling profit, other than a personal blog or social network where the primary purpose is to display content from Coral Dreams by hyperlink and not to compete with Coral Dreams.
Commercial Activities

Commercial activities with respect to the arts are permitted ONLY for Coral Dreams. Commercial activities in the form of paid advertising on Coral Dreams’ service and/or products are subject to the terms and conditions relating to the purchase of such advertising. No other commercial activities are permitted on or through the Website(www.coraldreamsart.com) without Coral Dreams’ written approval. Term 9, above, of these Terms of Service specifically applies with respect to commercial activities.

Suspension and Termination of Access and Membership

You agree that Coral Dreams may at any time, and without notice, suspend or terminate any user and/or account holder in Coral Dreams website, or refuse to fulfill any order, or any part of any order or terminate their membership, in Coral Dreams’ sole discretion, if you fail to comply with the terms or applicable law.

Product Purchases from the Coral Dreams Shop

From time to time, Coral Dreams may make certain products available for purchase through the www.coraldreamsart.com. For example, you may have the opportunity to purchase “Artwork” that a registered member has listed for sale through the Print Program. All payments are to be made in EURO, unless stated otherwise, and prices are subject to change at any time. Postage and applicable sales taxes will be added to your order during the checkout process. Prices do not include any import duties that may be added by the order destination country. Delivery dates are provided as an estimate only. In general, Coral Dreams accepts returns on defective products or incorrect orders within thirty (30) days after receipt of your order. Please contact Coral Dreams at www.coraldreamsart.com and we will let you know whether you need to return the product(s) to us. If you do need to make a return, simply send the product(s) within thirty (30) days of receipt in the original packaging along with a copy of your invoice or order acknowledgement. Original shipping charges are not refunded on returned items. Customers are responsible for all shipping charges back to Coral Dreams on returned items, and Coral Dreams will pay the shipping charges on replacement product(s). Returns can be for replacement, refund or credit at Coral Dreams’ discretion. If your return merchandise is accepted, we will post a credit to your account within 48 hours from the time that we receive the product(s). Each return is credited in the same manner as payment of return. If you paid for your order with a credit card, the credit will be applied to that card, except in cryptocurrency payments, in which Coral Dreams will decide at its discretion the mode and/or method and/or currency and/or cryptocurrency of return and/or refund (See below Term 19). EXCEPT AS EXPRESSLY PROVIDED IN THIS Term 18, ANY PRODUCT PURCHASED THROUGH THE CORAL DREAMS WEBSITE IS PROVIDED ON AN “AS IS” BASIS. CORAL DREAMS’ SOLE OBLIGATION, AND YOUR SOLE AND EXCLUSIVE REMEDY, WITH RESPECT TO ANY DEFECTIVE PRODUCT PURCHASED THROUGH THE CORAL DREAMS WEBSITE, SHALL BE FOR CORAL DREAMS TO PROVIDE A REPLACEMENT, REFUND OR CREDIT, AS SPECIFIED IN THE PRECEDING Term (Term 18).

Cryptocurrency

Coral Dreams enables cryptocurrency payments and earnings withdrawals via a Third Party Software blockchain/cryptocurrency payment processor (“Cryptocurrency Payment Services“). You acknowledge and agree that regardless of the manner in which such Cryptocurrency Payment Services may be offered to you, Coral Dreams merely acts as an intermediary platform between you and the applicable Cryptocurrency Payment Services provider, and shall not be in any way responsible or liable with respect to any services provided by such Cryptocurrency Payment Services provider. Any, and all use of Cryptocurrency Payment Services shall be done solely at your own risk and responsibility, and may be subject to certain legal and financial terms which govern Cryptocurrency Payment Services, which you are encouraged to review and understand before using such services. Additionally, the use of Cryptocurrency Payment Services is subject to the applicable terms of use of the Cryptocurrency Payment Services provider, including, but not limited to, the lists of prohibited items and businesses not supported by such provider. In the case of BitPay, your use of Cryptocurrency Payment Services is subject to BitPay’s terms of use. Each Cryptocurrency Payment Services provider may support different cryptocurrencies, however Coral Dreams has full discretion regarding which cryptocurrencies will be available through the Cryptocurrency Payment Services on the Coral Dreams platform. Please avoid paying in unsupported cryptocurrencies, as doing so may result in loss of funds which Coral Dreams will absolutely bear no responsibility. While we hope to avoid such instances, Coral Dreams may, at any time and at its sole discretion, suspend, disable access to, or remove Cryptocurrency Payment Services without any liability to you or to any third party. You assume the volatility risk and /or any other risk of the cryptocurrencies in which cryptocurrency transactions occur. Any possible refunds of cryptocurrency transactions are subject to Coral Dreams’ sole discretion and/or decision and/or choice, and the mode and/or method of refund of cryptocurrency payments is upon Coral Dreams’ discretion and/or decision and/or choice.
